Terms of Service

1. About Eleplated

Eleplated is a circular economy marketplace for professional restaurant and hospitality tableware, serving buyers and sellers across the European Union. By accessing or using the platform, you agree to these Terms of Service in full.

2. Eligibility

You must be at least 18 years old to use Eleplated. The platform is open to both individuals and registered businesses within the EU and EEA. By registering, you confirm that the information you provide is accurate and that you have the legal capacity to enter into binding agreements.

3. Listings

Sellers are solely responsible for the accuracy of their listings, including item descriptions, photos, condition ratings, and pricing. By creating a listing, you confirm that:

• You own the item or have the right to sell it.
• The item is professional tableware (plates, bowls, glasses, cutlery, serving ware, or related hospitality items).
• The description and photos accurately represent the item's current condition.
• The item is not counterfeit, stolen, or otherwise prohibited.

Eleplated reserves the right to remove any listing that violates these terms without notice.

4. Prohibited Items and Conduct

The following are prohibited on Eleplated:

• Counterfeit or replica goods.
• Non-tableware categories (food, beverages, equipment, furniture, etc.).
• Spam listings, duplicate listings, or artificially inflated prices.
• Any conduct intended to defraud buyers, sellers, or Eleplated.
• Circumventing platform payments by conducting transactions off-platform.

5. Transactions and Payments

All payments are processed through Stripe. Eleplated charges a 12% platform feeon each completed transaction, deducted from the seller's payout. Prices are displayed in euros (EUR).

A transaction is considered complete when the buyer's payment is confirmed. Sellers will receive their payout, minus the platform fee, according to Stripe's standard payout schedule.

6. Pickup and Delivery

Eleplated is a pickup-first marketplace. After a purchase is confirmed, the buyer is responsible for arranging collection directly with the seller. Eleplated does not arrange or guarantee shipping or delivery. Any shipping arrangements made between buyer and seller are at their own risk.

7. Disputes

If you have a dispute relating to a transaction, you must contact Eleplated support at contact@eleplated.shop within 14 daysof the transaction date. We will review the case and may, at our discretion, facilitate a resolution or issue a refund. Eleplated's decision in dispute cases is final.

8. Limitation of Liability

Eleplated is a marketplace platform and is not a party to transactions between buyers and sellers. We do not verify the condition, quality, or authenticity of listed items.

To the fullest extent permitted by applicable law, Eleplated shall not be liable for any indirect, incidental, or consequential damages arising from the use of the platform, including but not limited to loss of profit, loss of data, or loss of goods. Our total liability for any claim shall not exceed the platform fee collected in the relevant transaction.

9. Account Termination

Eleplated reserves the right to suspend or permanently terminate any account that violates these terms, engages in fraudulent activity, or poses a risk to other users or the platform. You may delete your own account at any time from your profile settings.

10. Changes to These Terms

We may update these terms from time to time. We will notify registered users of material changes by email. Continued use of the platform after changes take effect constitutes acceptance of the revised terms.

11. Governing Law

These terms are governed by the laws of the Netherlands. Any disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands, without prejudice to mandatory consumer protection rights under applicable EU law.
